MINORITY/DISADVANTAGED BUSINESS ENTERPRISE MANAGER

 

GENERAL DEFINITION

 

          This is administrative management work directing through subordinate supervisors the activities of employees engaged in minority/disadvantaged business contract participation and compliance work for the Airport, Office of Economic Opportunity or Department of Planning and Development.  Work includes planning, developing, administering, evaluating, and coordinating the implementation of the goals and objectives according to federal, state and/or local regulations.  Employees in this class direct the formulation and implementation of agency policy in areas such as certification and contract compliance.  The employee in the Office of Economic Opportunity assignment serves as the across-the-board assistant to the director with responsibility for supervising the daily operations of the Minority Business Enterprise Council staff.  The employee in the Airport assignment directs the Disadvantaged Business Enterprise Program (DBE) and Airport Concessionaire Disadvantaged Business Enterprise Program (ADBE) and compliance programs according to federal regulations at the Philadelphia International Airport and Northeast Airport. The employee in the Department of Planning and Development supervises staff engaged in participation and compliance activities of federally-subsidized development projects and non-subsidized development projects involving publicly-owned land. Coordination with department executives, other government agencies and departmental managers is significant to the work.  Employees in this class report to an Executive Director or a Deputy Director.

 

ALLOCATING FACTORS (The following conditions must be met for a position to be allocated to this class.)

 

1.    The position must direct, through subordinate supervisors, the activities of employees engaged in disadvantaged business enterprise contract compliance work.

2.    The position must direct the formulation and implementation of agency policy in areas such as certification and/or contract compliance.

3.    Only one position may be allocated to this class in the Department of Commerce.

4.    Only one position may be allocated to this class in the Department of Planning and          Development.

5.    Only one position may be allocated to this class in the Department of Aviation.

 

TYPICAL EXAMPLES OF WORK (ILLUSTRATIVE ONLY)

 

ALL ASSIGNMENTS

 

          Directs the work of staff engaged in contract compliance for minority, disabled- and female-controlled and other disadvantaged firms; oversees the review of bids and compliance plans for conformance with governmental rules, guidelines, and regulations; sets priorities; provides technical guidance to subordinates; assumes the role of director in his/her absence.

          Confers with subordinate supervisors to define and discuss problems, policies, and special cases or projects; outlines and recommends appropriate actions and solutions; reviews and analyzes operational methods and progress for conformance with program.

          Performs personnel function as determined by departmental needs, methods, and procedures; interviews and offers employment to certified eligibles; discusses disciplinary matters, employee grievances, and other problems with subordinates and supervisor.

          Provides outreach to local stakeholders and community groups; participates in and conducts seminars, workshops, panel discussions and training sessions on program requirements, available projects and bidding, construction and certification processes.

          Performs related work as required.

 

OFFICE OF ECONOMIC OPPORTUNITY ASSIGNMENT

 

          Participates with the Executive Director and the Minority Business Enterprise Council in the formulation of policy and programs governing the operations of the division; attends meetings to discuss guidelines, new and existing programs, forms and policies;

          Reviews recommendations made by subordinate staff members for information to support conclusions and for conformance to established standards of quality.

          Performs related work as required.

 

AIRPORT ASSIGNMENT

 

          Directs the work of staff engaged in the vendor certification process and contract compliance for Disadvantaged Business Enterprise (DBE) and Airport Concessionaire Disadvantaged Business Enterprise Program (ACDBE) of the U.S. Department of Transportation (U.S. DOT) pursuant to federal regulations; supervises the review of applications and financial forms requesting certification; directs annual compliance monitoring and represents the Airport in annual audit of DBE and ACDBE programs.

          Sets priorities for staffing needs and participates in goal setting for program contracts and concessions; resolves issues with vendors and monitors contracts; testifies for the department at appeal hearings.

          Prepares materials for reporting and briefs senior officials and City council representatives for informational and budgetary purposes; investigates and prepares reports of finding of allegations of prime contractor discrimination and non-compliance practices against firms.

           Performs related work as required.

 

DEPARTMENT OF PLANNING AND DEVELOPMENT ASSIGNMENT

 

     Directs staff engaged in on-site monitoring and reporting of housing and community development construction contractors and professional service providers for compliance with all local, state and federal participation goals and other requirements and regulations; directs the development and evaluation of Economic Opportunity Plans (EOP) for federally-subsidized housing and community development projects and for non-subsidized development projects involving publicly-owned land.

     Prepares reports required by the Department of Housing and Urban Development, Office of Economic Opportunity and quasi-governmental agencies such as the Philadelphia Redevelopment Authority, Philadelphia Housing Development Corporation, Philadelphia Land Bank and other City agencies; develops and completes reports, briefings and testimony to City Council.

     Conducts ongoing review and interpretation of federal, state and local legislation, ordinances, court decisions, and legal opinions and works with staff of OEO, the Law Department and other City agencies to ensure projects and programs are in compliance with all equal opportunity laws and rules and regulations.

     Develops and implements policies and strategies to increase certification and participation of minority contractors in government contracts.

          Performs related work as required.

MINIMUM ACCEPTABLE TRAINING AND EXPERIENCE (The following statement represents the minimum training and experience standards which will be used to admit or reject applicants for tests.  Applications submitted by candidates for this class will be reviewed based on training and experience requirements as approved on 5/24.)

 

EDUCATION:

 

          Completion of a bachelor's degree program at an accredited college or university.

 

NOTE: Certification as Certified Compliance Administrator by the American Contract Compliance Association or an industry relevant certification or additional experience on a year for year basis may substitute for the required degree.

 

AND

GENERAL EXPERIENCE:

 

          Four years of experience monitoring compliance with governmental guidelines pertaining to affirmative action and/or dissemination for a public agency.

 

AND
SPECIFIC EXPERIENCE
:

 

          Two years of either supervising a staff engaged in disadvantaged business enterprise certification and/or compliance work ensuring municipal or federal compliance with rules, regulations, and guidelines encouraging the selection of minority/disadvantaged business enterprises OR performing administrative analysis and management work with delegated authority related to a minority business program and reporting to a Deputy Commissioner or Commissioner or equivalent.

 

NOTE:  Completion of Certification as a Master Contract Administrator by the American Contract Compliance Association is preferred and may substitute for two years of the general experience.

         

NOTE:  Completion of a master’s degree or certificate program from an accredited college or university or recognized professional association in a related field may substitute for one year of the required experience.

Any equivalent combination of education and experience determined to be acceptable by the Office of Human Resources, which has included the specific experience.

 

PHYSICAL AND MEDICAL REQUIREMENTS

 

          Ability to physically perform the duties and to work in the environmental conditions required of a position in this class.

 

LICENSES, CERTIFICATIONS AND REGISTRATIONS

 

Employees in the Airport Assignment must be able to pass and maintain SIDA (Security Identification Display Area) and AOA (Airfield Operations Area) clearance during tenure of employment as the Minority/Disadvantaged Business Enterprise Manager.
